In these terms and conditions, references to “HydraTech”, “we”, “us”, or “our” mean HydraTech Enterprise. References to “you”, “your” and “your party” refers to the client or the end user of our services/products.
Our agreement with you defines what you are legally entitled to expect from us and our third party suppliers when you engage in our services . We sell a variety of services and you should make sure you understand the terms and conditions which apply to your particular project contract agreement in addition to these general terms and conditions.
The following terms and conditions apply to all services and products provided by HydraTech to the client.
Acceptance
It is not necessary for any client to have signed an acceptance of these terms and conditions for them to apply. If a client accepts a quote then the client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any purchase or use of our services/products implies that you have read and accepted our terms and conditions.
Charges
Charges for services to be provided by HydraTech are defined in the project quotation or the project contract that the client receives via e-mail. Quotations are valid for a period of 30 days. HydraTech reserves the right to alter or decline to provide a quotation after expiry of the 30 days.
For any additional services requested by the client that is not included in the project quotation or the project contract, will be additionally charged.
Unless agreed otherwise with the client, all our services require an advance payment of a minimum of 50% of the project quotation, inorder to initate the project. The remaining 50% of the balance is due upon completion of the work, prior to releasing the final deliverables.
Termination
Termination of services by the client must be requested in a written notice and will be effective on receipt of such notice. Telephone requests for termination of services will not be honored unless confirmed in writing. The client will be invoiced for work completed to the date of first notice of cancellation for payment in full within 30 days.
In an event where the client fails to comply with our payment policies stipulated in the project contract or in our general terms & conditions, we reserve the right to terminate the service temporarily until the payment has been fully completed by the client. We also reserve the right to permanently terminate the service if the client is not responsive for more than six months, regardless of any advance payment – unless stated otherwise in the project contract agreement.
Indemnity
You agree to indemnify and hold HydraTech harmless from any claims resulting from your use of our service/product that damages you or any other party.
Copyright
The client retains the copyright to data & files provided by the client to us for the intended service, and grants HydraTech the rights to publish and use such material. The client must obtain permission and rights to use any information or files that are copyrighted by a third party. The client is further responsible for granting HydraTech permission and rights for use of the same and agrees to indemnify and hold harmless HydraTech from any and all claims resulting from the client’s negligence or inability to obtain proper copyright permissions. A contract for the service and/or placement shall be regarded as a guarantee by the Client to HydraTech that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested.
Changes To Our Terms & Conditions
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 14 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
